What Is a Traumatic Brain Injury?

A traumatic brain injury occurs when an external mechanical force disrupts normal brain function. TBIs are broadly classified into mild (concussion), moderate, and severe categories, but even a "mild" TBI can produce persistent and disabling symptoms. The brain's complexity means that TBIs with similar imaging findings can produce vastly different functional outcomes, and standard imaging may appear normal even in the presence of significant injury.

The Centers for Disease Control and Prevention identifies falls and motor vehicle accidents as the two leading causes of TBI — both common occurrences in Lowndes County and on South Georgia's roadways.

Types of Traumatic Brain Injuries

  • Concussion: A mild TBI caused by a blow or jolt to the head. Symptoms may include headache, confusion, memory gaps, dizziness, and light sensitivity. Post-concussive syndrome can persist for months or years.
  • Contusion: A bruise on the brain tissue itself, often at the site of impact and on the opposite side of the skull (coup-contrecoup)
  • Diffuse axonal injury (DAI): Widespread tearing of nerve fibers from rapid acceleration-deceleration forces, common in high-speed vehicle accidents. DAI often produces severe, permanent neurological deficits.
  • Epidural and subdural hematomas: Bleeding between the brain and the skull that creates life-threatening pressure on brain tissue, often requiring emergency surgical intervention
  • Intracranial hemorrhage: Bleeding within brain tissue itself, which can cause immediate and permanent neurological damage depending on location and volume

Symptoms and Long-Term Effects of TBI

  • Persistent headaches and migraines that do not respond to standard treatment
  • Memory impairment, including difficulty forming new memories and retrieving recent information
  • Cognitive slowing, difficulty concentrating, and impaired executive function
  • Personality changes, increased irritability, emotional volatility, and depression
  • Sleep disturbances, including insomnia and hypersomnia
  • Sensitivity to light and sound
  • Speech and language impairment, including aphasia and word-finding difficulties
  • Seizure disorders requiring long-term anticonvulsant management
  • Balance and coordination problems affecting mobility and fall risk

Why Insurance Companies Dispute TBI Claims

TBIs — particularly mild to moderate injuries — are frequently disputed by insurance carriers who argue that normal CT and MRI imaging proves no brain injury occurred. This approach ignores the medical reality that standard imaging is insensitive to many TBI types, particularly diffuse axonal injury and mild concussive injuries. Our attorneys work with neurologists, neuropsychologists, and neuroradiologists who use advanced diagnostics and cognitive testing to document the true extent of your injury.

Georgia Damages — Future Medical Needs

O.C.G.A. § 51-12-4: Recoverable damages include all injuries and expenses incurred as a consequence of the defendant's negligence, including future damages that are established with reasonable certainty. In TBI cases, certified life care planners prepare detailed plans documenting projected medical, therapeutic, and supportive care costs over the plaintiff's lifetime.
